I am trying to understand if an on-call allowance would be categorised as OTE or overtime. I am looking at SGR 2009/2 paragraph 44 but struggling to understand how it would apply to this situation.


The on call allowance is paid:


Each pay period, regardless of whether the employee is on call that pay period

As a percentage loading on their regular wages.

The on call role applies during regular hours as well as outside of hours.

No additional payment is made if the employee is called in to work.


How should this allowance be classified in respect of the super guarantee?

You are saying that this allowance is paid as an additional amount for their ordinary hours of work and the purpose is to be available to perform additional work during those ordinary hours or outside of their ordinary hours? That they get paid it even if they're not "on-call"?

However, check with your IR/HR/compliance team that drafted your Agreement, to see if they obtained written ATO guidance on the SG classification of this business-specific allowance. If not, you should seek a private ruling now, as you should not be "guessing" your SG obligations 😉 You should also ensure that this critical step forms part of future Agreement developments 🤓
