I had worked in a restaurant in Melbourne from September 2024 to July 2025. During this period they never made a deposit in y super account, and the super company has closed my account due to lack of deposits. According to the payslips, thery are suppose to have made payments but since the account is close there is resonable doubt that the company has ever made the payment.

I had enquire to the company and they said that is a lost account, that ATO is aware of it and that I just have to wait. After getting the mail from the Super company, I enquire to the restautant HR again, because if my account has been shut down, they won't be able to made deposits. And they answet with the same exact template they did the first time.

I talk to some tax specialist, and they said is the typical case of the company not paying the super, I tried to talked to restaurant HR a third time, since I was leaving the restaurant and leaving Australia. And they refuse to informed when the payments were done, and denied to confirmed the account to were the payments were done. Basically they deny any assistance with this situation and kept saying that is ok because ATO is aware of it.

I talk with several colleagues, and they haven't received any super deposits either, and the ones that hd left the company before me, had received the sae answer saying is a lost account.

How can I recover my super? specially since the super company has closed my account and I had to go back to my country of origin?

That sounds a situation for an unpaid super enquiry, that you can lodge with the ATO.


Fill in as much details you have about the periods you worked for the company and they will investigate to see if any super has been paid, where it is/went and attempt to recover any more amounts that they decide you may be eligible for. 😊
