Hi,


I'm trying to do an after-tax super contribution (of 15k) and include it in my first home super saver scheme withdrawal within the same financial year, but then claim a tax deduction at EOFY, with the 15% tax applied to make it a concessional contribution). I contacted the ATO and my super fund before making the contribution and they both claimed that this would not be an issue (plus the ATO website very specifically mentions "or non-concessional contributions that you intend to claim a tax deduction for" under the voluntary concessional contributions in the eligible contributions section). They stated that I just needed to submit Notice of Intent to Claim a Tax Deduction form before submitting the FHSS Determination. I have also seen several questions on here mentioning this as if it's not an issue. HOWEVER, in practice, after doing the contribution and notice of intent (plus getting confirmation and seeing the 15% tax in my super) when I try to input the contribution into the 'Personal super contribution deductions' (which, again, states "Include any that you intend to claim.") and select FY25-26, there is an error in the form "You do not have personal voluntary contributions for this financial year". The contribution does automatically get pre-filled into the 'Voluntary contributions' section, but as an after tax contribution.


I've called the ATO twice and gotten completely different answers each time. They initially said to wait for a few days (since I called the day after I got confirmation of my notice of intent to claim a deduction form and I saw the 15% tax come out from my super balance) and then it should auto populate in the 'Personal super contribution deductions' section of the determination form (or at least not cause an error when I input it there). I called again a week and a half later and, after initially being told I'd have to wait until EOFY (which is either completely wrong or the ATO website is objectively lying), he ended up suggesting that I should put 12,750 (15k contribution minus 15% tax that was applied by my super fund) as an after-tax contribution in the 'Voluntary contributions' section of the determination form.


The second option doesn't sound correct (and there would surely be mention of this somewhere online if it was), but I've already waited much longer than the first person suggested, plus the other person that I called before I did the contribution said I would be able to do it immediately after getting contribution of the NOI, so I've gotten 3 different answers from the ATO and none of them seem to be correct. Can anyone help?

After playing around with the form a bunch, I think I've worked it out. In case anyone else is wondering, I think that you actually need to include the contribution in BOTH the 'Voluntary contributions' and the 'Personal super contribution deductions' sections. The latter gives the error only when you don't specify the contributions in the former. I did the determination like this and the receipt shows that 15k as a concessional contribution with the 15% tax removed, as expected.


(Why do the ATO staff not know this is how the form works, I called 3 separate times and none of them knew lol)

Hi @jessie_tonkin - We do have an update from our experts and aligns with what you've said.


If you’ve made a non-concessional contribution this financial year, submitted a notice of intent to claim a deduction, and the contribution shows in your super statement, then the following steps must happen:

  • when opening the FHSS determination the non-concessional contribution will prefill as non-concessional (it won’t change to concessional)
  • there’s a Personal Super Contributions Deductions (PSCD) section under the Voluntary contributions section, which means:
    • this section will try to prefill any deductions claimed for previous years but won’t be able to prefill the current 2026 financial year
    • if you submitted a NOI for the current 2026 FY and this was accepted by your superfund, you’ll need to manually enter this deduction in this PSCD section
    • by entering the deduction for the 2026 FY in the PSCD section of the determination, this will allow the system to automatically re-classify the non-concessional contribution in question
    • it's treated as a concessional contribution instead when it calculates the maximum releasable amount.

Once you submit your determination you should be able to see the summary of concessional vs non concessional amounts (after the system reclassifies the contribution) in the summary to confirm.
