Hi all,


My PR was automatically cancelled this year under operation of law, as I was a dependent of an ex-partner's whose PR was cancelled. My question is as the PR was cancelled years after grant and most of my super is accumulated under this PR, how can I claim DASP?


When I try to apply via the DASP online portal, I get this message:

‘Not eligible – not known. Based on information supplied to us by the Australian Department of Home Affairs we are unable to establish that you are the holder of a temporary resident’s visa under the Migration Act 1958.

This is because DHA records still show that I held PR, even though legally the visa was never valid. I called the ATO and the person on the line said as my fund is with Hostplus, I can work with them directly but the people from Hostplus said: "Please be advised DASP will be assessed as per the visa conditions mentioned on ATO online. Please note DASP is calculated on the entire balance as per the ATO Online visa conditions" and they want me to apply via the ATO portal, which doesnt work.


Any advice would be appreciated.

Hi @DachDach,


You can only claim DASP for super contributions earned while holding an eligible temporary visa. Since your PR was legally invalid from grant due to the automatic cancellation, you may be able to claim DASP for super accumulated during any temporary visa period you held before the PR grant.


The issue with the online portal happens because Department of Home Affairs records don’t match your actual visa status, which stops the application from working.


For this specific situation it's best to email our dedicated DASP team, include your full details and explanation so they can assess your eligibility for the period when you held a temporary visa.
