Hello,

Apologies in advance as this is quite a long winded question. I believe there has been some errors along the way between my workplace, leasing company & the ATO, which has resulted in a $10k family tax benefit debt for me. I would just like advice on the below to see if there has been an issue & how to resolve. Payroll have said they put in the info provided from the leasing company, and the leasing company haven’t responded to my calls or emails, and centerlink told me to contact the ATO but I want to ensure I have the correct info first as I’m better at typing than explaining verbally.

My employer was a government employer, and the lease was a fully private use, no business use.

the info from the lease (A) - not sure which part is relevant or if you need more info

info from my end of year income statement from work (B)

I was under impression the FBT wouldn’t be applicable to me as it was a fully private use vehicle & no other tax implications for me as I made both pre and post tax contributions. However the ATO generated report to Centrelink had my income reported at $140,000~ rather than $126,870; & the only way I can assume that number came from is from the FBT?

any help or advice appreciated.

If you make after tax contributions to reduce the FBT value to nil, your reportable fringe benefits amount should also be nil.

Your after tax contribution of $7,435.16 implies that the cost price of the car is $37,175, assuming that you had the car for the full FBT year. If this is the case, your contribution would have reduced the FBT value to nil.

Your questions to the packaging provider or employer are:

  1. What is the cost price of the car?
  2. What is the FBT value, before deducting after-tax contributions, relating to the car for the year?
  3. What is the FBT value after deducting after-tax contributions?
  4. If the answer to Q3. is nil, should the RFBA also be nil?
  5. Do you believe that the RFBA amount of $14,028.66 is incorrect? If so, should it be nil?
  6. If the correct RFBA is not nil, what were the calculations used to ascertain that amount?
  7. I the correct RFBA is nil, how and when will the correct information be communicated to Centrelink and/or my employer?

If you are finding it difficult to get answers from the packaging provider it might be better for your employer to send them those questions.

Thansk so much! Yes that’s correct, on all my lease paper work it has all the RFBA as 0! And work said they can’t change anything on the tax screen in their reporting as the info is autogenerated from the lease company. I just wanted to ensure before I take it any further that I had not misunderstood anything. You’re amazing, thank you!
