I run a farm in partnership with my wife. The farm is owned by our superfund and is valued at $1m. We pay a commercial rent. We have over $100k of assets (stock and equipment) in the partnership. We believe that we meet some of the 4 criteria to qualify as a commercial business and have ticked the appropriate boxes in Mytax.

In 2025 the partnership incurred a loss.

When I did my tax return using Mytax it defaulted to a “deferred non commercial business loss”.

The ATO has not deducted my farm loss from my non-farm income.

1. Is the tax treatment correct.

2.If not correct, then how can I contact the ATO to get it amended. Telephone doesn’t get through and I can’t find any appropriate portal that doesn’t fit into any of its pre determined boxes.
