Hi,

In the 24/25 financial year my taxable income on my lodged ITR was $35,315. More than 10% of this is salary.

I made a non-concessional contribution to super of $1,000 on the 11th June 25 as I believed this would make me eligible for the $500 co contribution.

I received a $500 LISTO contribution to my super in Jan 26 and I called the ATO today to ask about whether I would receive the co contribution.

I have been told that I can't receive both as I only put $1,000 NC contribution in. I was told that if I had put $2,000 I would have received both.

I can't see anywhere in the eligibility criteria for LISTO and co contribution that says you can only receive 1 if contribute $1,000. Can you clarify the rules on receiving both?

Double check each condition for eligibility

  1. This one need to be careful, it's adjusted income not taxable income. Generally, add back negative gearing, deductible super contribution, salary-sacrifice super and so on

"You're eligible for the LISTO if you satisfy all of the following requirements:

  • you or your employer pay concessional (before tax) contributions (including super guarantee amounts) for the year to a complying super fund
  • you earn $37,000 or less a year – to work out your eligibility, we use your actual or estimated adjusted taxable income)
  • you have not held a temporary resident visa at any time during the income year (note that New Zealand citizens in Australia are eligible for the payment)
  • you lodge a tax return and 10% or more of your total income comes from business and/or employment, or you don't lodge a tax return and 10% or more of your total income comes from your employment."

Thanks for your reply. I definitely fit all the eligibility criteria for LISTO, and did receive the $500 payment entitled LISTO to my fund this year. My employer contributed to the fund and my adjusted income is still the same as my ITR taxable income according to the ATO calculator.

It was the government co contribution that I haven't received and I was confused as to why I can only receive LISTO and not this.

In addition to the points listed above, I did the $1000 non-concessional contribution in the correct financial year and definitely didn't claim it as concessional on my tax return. I assumed this was the trigger for the co contribution but have been told it's not as I needed to have another $1000 contribution to get that too. This doesn't seem correct when I look at the ATO guidelines on their website.

You are not able to get both LISTO and co-contribution on the same $1,000. This is because LISTO only applies to concessional contributions and co-contributions can only apply to non-concessional contributions.

If you have already received a $500 LISTO amount, this possibly relates to concessional contributions made by your employer. If that is the case you might also be able to get the co-contribution relating to your personal non-concessional contribution. If you converted that to a concessional contribution, you would not be eligible for the co-contribution.

If you haven't yet received a co-contribution, check the eligibility criteria. If you think you are eligible, contact the ATO with the full details.

Thanks for your reply.

I received concessional contributions from my employer throughout the 25 FY, roughly $3425.

I put a personal $1000 on top of this which was not claimed as concessional in my tax return.

I think it is possibly worth calling again as maybe the agent I spoke to didn't realise I had both types of contributions throughout the year.
