Good Day to each and All,

After 5 years of living and working in Australia, as a European expat, I had to leave in 2019.

With the Covid-19 and many other factors,It has been clear to me that I will not be returning in Australia for any foreseable future.

In order to streamline my personal administration and accountancy, I decided to close any accounts I have in Australia, savings,super etc...

Now Since I decided to do It in May 2021, my super went to the ATO, as per the rule, by all acounts.

After verifying my eligibility, with both the ATO and Australian Foreign Office.

I, then filed my DASP, so I can cash out my hard earned money and as per the rule,I am entitled to.

All of It, from France, with the time difference and the phone rates that It entails.

After nary an update, and getting my mailman to be on the lookout for any non-European mail.

I decided to hop on back on here, to see what is going on.

Only to find out that my Personal details have been changed.

Apparently I am now an Australian Resident, and was never a Working Holiday Maker.

Good News for Me I guess. My super is still held by the ATO.

Now I held whm twice then I did apply for a Partner (Temporary) (class UK) (subclass820) / Partner (Residence) (class BS) (subclass 801) visa , for which I obtained a briding visa , that I held until the very day I left.

I was never a permanent resident. I never held anything beyond working holiday and the aforementioned bridiging visa. I double checked,and trust me having to go back into my immi account, after so long has passed is not fun.

Again, before even starting the process, I did call the ATO and Foreign Office, who both assured me that I'm still considered a temporary resident, hence, unlike Australians I do not need to justify the withdrawal of my ATO held SUPER, and as such I will also be taxed up to 35%.

All I need to do is to file a DASP.

Keep in mind, the online application, will show eligibility when entering your passport number, as the latter is linked to your immigration account with the accurate and updated visa status.

So If I was a Permanent resident, I couldn't even go through past the 1st page.

Now I've done the same process again, the DASP went through, with an expected 28 days processing, because of course.

Now that I think about It, both times I did not receive any confirmation. on the ATO message nor my contact e-mail.

Now I would appreciate, from the bottom of my heart. If there's anyone would could send me into the right direction, a direct e-mail, a direct phone line, the relevant online application.

ANYTHING for me to be done with Australia.

Once and for All

One of the best experiences in my life, is becoming resentful by the day.

Through this forum we would only be able to provide you with general information and not account specific information.

Unfortunately, I would not be able to say why you were suddenly considered a resident for tax purposes not being able to apply for DASP the first time around. I would recommend that you check your VISA status through VEVO.

None the less if you were a WHM your application for DASP can take longer to process if your information does not match. That could be one reason it is taking so long to process.

Our advice is to await the 28 day processing time frame and If you have not heard back, then to contact us directly on the number listed under Overseas Enquiries - General and ask to speak to our superannuation department.

Hello,

Thank You for your prompt answer. I really appreciate It.

My original DASP application was done around the 2nd of May 2021.

It's been well over the 28 days timeframe by now, hence my frustration.

At the time, I looked up the whole process before even going about It.

Australia Visa/Immigration administration can be daunting so I came prepared.

Checked by phone with both ATO and Foreign Office with all the necessary and relevant infos, as well as my online immigration account attached to my passport.

I filled the DASP online process accordingly, keep in mind that there are steps that cannot go through If your visa status attached to your passport number is not of the right eligibility criteria. I even added a 2nd contact number, on top of my european one, as I still have my Oz sim card that I sometimes use.

So upon checking yesterday, imagine my surprise that nothing changed, and for some reason my ATO account, had my status as resident and "NO" under WHM, which has never been the case,even when I had the bridging visa, waiting on Partner visa outcome.

All those details are a bit odd. Maybe someone with the same nationality and name, or some glitch, who knows.

Anywho, thanks for getting back to me so quickly, with all info to help me sort this out.

I'll put It aside, at least to enjoy my weekend.

Hello,

Still no trace of my cheque in the mail here in France.

I tried to call the overseas number You were kind enough to give me.

But there are always long waiting time then I get hang up on.

I have to stay up in the middle of the night so grumpy face at work for lack of proper sleep.

I also have to pay quite alot in phone bills just for that alone.

I haven't reached a human voice yet.

Is there any chance for an e-mail for that service or any service in the ATO that could help me solve the issue?

Hi @AliceSeke,

You're correct, you can apply for a DASP if you held a temporary resident visa. It sounds like we accepted your application if you were able to submit it online. However, as @RenATO advised, we do not have the ability to look into your account via this forum. You can request assistance with DASP online. This includes the following email address DASPmail@ato.gov.au, it also advises what information you'll need to provide in the email.
