ATO sent me a letter on 23 June 2023, and confirmed with me that the unpaid super has been received from former employer and transferred to my super account on 28 March 2023 but it's an inactive account. At the same date 23 June, I sent a letter to ATO and confirm new active account number. But, I haven't receive any money in my super account until today. Please advice me where is the money now and how long do I have to wait for receiving the super money? Thank you.

Generally, if your unpaid super has been paid to an inactive account. The receiving super fund will reject the payment back to us. We will then try to pay to another super account.


I suggest that you speak to us about your situation. As they can then access your account to investigate further for you.

No, Cbus received unpaid Super from ATO, but I don't trust Cbus then I consolidated all money to my an active Australian Super fund account. Cbus super fund keep over $4,500 for about 15% tax purpose without issuing a payment details statement as I requested. Please explain why Cbus tax me but ATO doesn't apply tax on my Super fund transferred from ATO to Cbus? Secondly, my super fund transfers from this fund to the other, it's not transfers to my own pocket or my bank account, why do I have to pay tax for that? Thank you for your help.

Hey @Hanhtran!


Super contributions can only be taxed once. That is coming into the fund, or upon leaving the fund (withdrawal) it can't be taxed at both ends.

 What information are you looking at that shows CBUS withholding

tax?

 Were the contributions made into CBUS only from employment, or were you personally contributing as well? I ask this because, from employment the funds will have been taxed already upon entry, and any personal contributions made won't have had tax withheld. So, it sounds like CBUS were obligated to withhold tax on the monies received that haven't been taxed.

 

Remember as well, any tax that has been paid in surplus will be refunded to you after you've submitted your tax return for the year.

ATO help me to claim this unpaid super from my former employer, then transferred whole amount to my Inactive Cbus account ( Cbus creates this account for me but I never use this account and login-out, also I don't have any password). I made an application to Australian Super (my Active Super Account) to roller whole amount from Cbus to Australian Super. Unfortunately, Cbus keep over $4500 as tax withhold. I did ask Cbus issues a statement as payslip but they refuses to do it. How do I claim this money as tax withhold at the end 2023-2024? or Cbus must transfers this money to my Australian Super? Thank you for your help.
