Can employers act as employee's authorized representative for Departing Australia Superannuation Payment (DASP)? Can the employer request on their behalf ATO for the Superannuation withdrawal for those temporary tax residents leaving Australia? Or is official tax representative required?

Hi @AUPS,

No, employers can't act as an authorised representative to process a departing Australia superannuation payment (DASP) on behalf of their employees. The DASP can only be claimed by the eligible temporary resident themselves or by an authorised person who meets specific requirements.

To apply for a DASP on behalf of a temporary resident, the person must be either a registered tax agent, or someone with conditional registration specifically for DASP purposes. These intermediaries can use the DASP online intermediary application system to submit claims.

If you're an employer wanting to assist departing employees, you'll need to direct them to either:

  • apply themselves using the DASP online application system, or
  • engage a registered tax agent who can act on their behalf.

You should also ensure all required superannuation contributions have been paid into their fund before they submit their application.
