Hi, i have finished my post graduate visa (485) and now i have returned to my home country. I have hold working and holiday visa (WHV) before. I would like to claim my DASP. How can i claim my DASP with only 35% tax?


My condition : I have separated superannuation account and I open the account when i hold the student visa, and i get all my superannuation contribution since i hold the student visa. I would like to claim DASP from this superannuation fund.

Hi @Khong,


The tax rate applied to your DASP depends on your visa history and when your super contributions were made, not just which super account holds the funds. If you've ever held a working holiday maker (WHM) visa (417 or 462 visa), your super fund will check whether your DASP includes amounts attributable to super contributions made while you held that visa.


The 35% tax rate (DASP ordinary tax rate) only applies if you've never held a WHM visa, or if you did hold a WHM visa but the DASP doesn't include any amounts from contributions made during that visa period.


The 65% tax rate (DASP WHM tax rate) applies to the entire payment if your DASP includes any amounts from super contributions made while you held a WHM visa, even if you earned other super under different visas like your student visa or post-graduate visa.


Your super fund determines which tax rate applies based on the information it holds about your contributions and your visa history. When you submit your DASP application through the online system, your visa information will be forwarded to your super fund. The fund will use this information to determine the appropriate tax rate.


It doesn't matter when you held the WHM visa – if you held one at any time and contributions were made during that period, the WHM rate applies to the entire payment.


If you believe your super fund has applied the wrong tax rate, you can contact your super fund directly and request a refund in the same financial year your DASP was paid. You'll need to provide evidence that the tax was withheld incorrectly. If your request is made after the end of the financial year, you can lodge a refund request with us in writing.
