I’ve been informed that the ATO has lost my notification of deceased person, sent in May, and verified as having been delivered by Australia Post.

My question - is there anyone from the ATO reading this with enough seniority willing to adopt a common sense approach, and simply go directly to the Victorian Supreme Court’s website and view the original grant of probate.

This document is straight from the horse’s mouth. It does not need to be certified, and is not issued without a death certificate. Making it available online is obviously intended to reduce bureaucracy.

It is dead easy to view, once the relevant references are provided by the executor.

Instead, I am left having to chase up certified copies, post them off again, and hope that the same thing does not happen again.

Please, please, ATO, let’s save time and effort for both me and your staff by viewing the grant of probate directly on the Supreme court’s website.

Is there anyone that can send this up the chain of command to solve this problem?

Hey @wearyExec,

We have specific procedures that we need to follow, and each procedure will have different requirements when we're updating a record. This is to ensure the updates are being requested by the correct authorised person and to protect the security of the account being updated.

However, we are always open to feedback and any feedback you have can be provided through our website.

Does the ato have a procedure for not losing our paperwork in the first place. You lost paperwork of mine and only 10 years, yes ten years later was it resolved - and you never justified how it was lost even though it was certified. ATO needs to step up and take some responsibility for its shortcomings.

Thank you for your reply.

With respect, I am asking why the authority of the Supreme Court (via their website) is not a good enough source to accept in establishing that a person is in fact authorised.

Totally agree with you. I have the same issue in SA. Since Nov 2018, anyone can access the ORIGINAL grant of probate from the CourtsSA site. The ATO come back with their ‘procedures’ line and expect a certified copy. They have access to the original! Get up with the E-document era ATO. Your ‘procedures’ are out of date and nonsensical. This really needs to be addressed. It’s ridiculous.
