Hi All. This is probably more directed to the ATO employees that are in the group to help answer. But all help is great.

So my tax agent lodged my return on the 7th July 2023. There is a credit owing to me. I have been previously bankrupt but have cleared that at start of the year and ATO has acknowledged. I have been told i have no tax debt and that it is noted on my account. However, 4 months in and no refund. Have been told a couple of months ago that past bankrupts are been scrutinized by the ATO and earlier in the year i have been told that because the system does not auto wipe your bankruptcy it will take months for a return. Not sure who to trust and believe anymore. Can not speak to anyone as system hangs up on you. Totally pissed and frustrated. Have been told this will happen every year a return is lodged due to past bankruptcy. Any help from ATO spokesperson or contact number to call and get correct explanation and time frame for refund would be great.

Hi @K91

I get that would be frustrating. If you've been bankrupt your return normally does take longer to process and I know it's not ideal. If you're facing hardship you can request priority processing. Our insolvency team can possibly discuss the process after you've been discharged.

As you know you need to talk to someone from the ATO that can assist, especially seeing your tax agent is not that helpful with your situation.

What you need to do is lodge a formal complaint.

Once you do that a tax officer called a "resolver" will make initial contact with you and they will try to locate the best area within the ATO that will ulitmately call you and discuss the matter with you.

This process is a bit slow at the moment and it may take as long as three weeks from the day of lodging the complaint for a ATO resolver to get back to you.

To lodge a complaint just follow the process in this LINK.
