I have had someone reach out to me that is interested in teaching dance classes at my studio. My teachers are all ABN sole traders but this person is telling me that they are not able to get an ABN because they will only be contracted to me. I have been back and forth with this person trying to find out true facts and the correct information I need to be able to come to an agreement that ensures my business is protected and they will be covered under the studio’s insurance before they start. They have also mentioned to me they currently study, receive Centrelink and work set hours each fortnight on a casual basis which reaches their fortnightly income limit before it effects their payments. They’ve been told all teachers who work at a dance studio are to be employed and that they’re not able to obtain an ABN if they’re only teaching at one studio. I have taught dance at many studios, school vacation care’s and local events over the last 8 years and I have always been on an ABN. I need to know how much one can earn before it effects their tax threshold, can someone get an ABN if they’re only contracted to one business that is also not their only source of income. Also if they hold an ABN do they need to have their own insurance even though they’re covered under my insurance as a third party? I am really stumped on what to do, any information or advice is greatly appreciated.

Correct - they should be employees.
