I need some clarity around who needs to gets what document and in whose name ?

Wife attending IVF treatment , Husband wants to access his personal super . I understand I need to get a ATO compassionate form from GP ( wife name or husband name) , Specialist (wife name or husband name) and a Psyciatrist(wife name or husband name) ?

Invoices from service providers ( whose name should be on ).Pls clarify

Fair question.


You only actually need 2 x medical reports. 1 from psychiatrist, most important, and one from your gp or a specialist.


Yes you also need the quotes, it's great you've done your research!


If you're applying then you're the applicant, you can apply on behalf of your spouse/de facto, they're the patient. So whoever is having the treatment needs to be on the invoices/quotes.


It's called accessing your super to pay expenses on behalf of someone else.


The ATO have a great page with links to everything you need, you'll find it on ato.gov.au and put 73097 in the search bar of that page.


Keep in mind the application itself is found via myGov > ATO online > Super > Manage > Compassionate release.


That's where you'll fill in your details and upload your evidence ( 2 x medical reports and quotes/invoices).

The requirement for a second letter from your GP seems highly innapropriate for gay couples doing IVF via surrogacy. Do I really have to have my GP fill out an entire form stating that both person A and his husband are both male, and are therefore physically incapable of conceiving naturally?
