Subject: Clarification Regarding Early Release of Super on Compassionate Grounds


I understand that if funds withdrawn under compassionate grounds are not used for the approved purpose, it may lead to compliance issues or penalties.


However, I’m in a situation where the funds were released and withdrawn in good faith, based on the information provided at the time. Since then, I’ve discovered that the expected medical procedure was not actually carried out or was not adequate, and I now require additional treatment. Unfortunately, I no longer have sufficient superannuation funds to make another application under compassionate grounds.


Given this, I had considered voluntarily putting the funds back into my super account so that I could reapply when ready. However, I’ve been informed that once super is withdrawn under compassionate grounds, it cannot be “re-contributed” in a way that resets eligibility for another compassionate release.


Could you please clarify:


  1. What happens in situations like this where the procedure did not go ahead as originally planned?
  2. Is there any way to reapply or resolve this by voluntarily returning the funds?
  3. Are there alternative options for accessing further support for medical treatment when super funds are insufficient?

We understand, we're all human and things aren't always under our control. Having a previous release won't stop you from a release in the future. We aren't in the business of punishing people because life happened!


There is no specific mechanism for reversing the withdrawal or re-contributing under special rules. You can make a normal personal contribution if you would like the money to remain in your fund.


You can also just set the money aside and when the remainder that you need is available apply for release of that amount, it doesn't have to be the full value.


As far as other financial options available, that's not something we here can help you with but hopefully someone in the community might have some advice.
